This Privacy Policy and the accompanying Terms of Use and Disclaimer (together, the “Policy”) govern your access to and use of Next Heights CRM (the “Service”), operated by Next Heights (“we”, “us” or “our”). By creating an account, accessing the demo, or otherwise using the Service, you acknowledge that you have read and agree to this Policy. If you do not agree, please do not use the Service.

1. Who this Policy applies to

The Service is a business tool intended for real estate agencies and their authorised team members. If you use the Service on behalf of an organisation, you represent that you are authorised to accept this Policy for that organisation. Your agency’s administrator or owner controls your account, the data you can access, and may add, suspend, or remove your access at any time.

2. Information we collect

  • Account & profile data: name, email address, role, and login credentials.
  • Agency & CRM data: leads, contacts, properties, sellers, tasks, activities, notes, files, and analytics that you or your team enter into the Service.
  • Communications data: WhatsApp and message logs sent or received through connected business messaging integrations, including delivery status.
  • Usage & device data: log data, approximate location derived from IP, browser type, and interactions used to operate and secure the Service.
  • Billing data: subscription plan, seat count, payment dates, and invoices.

3. How we use information

We use the information to provide, maintain, secure, and improve the Service; to authenticate users and enforce access controls; to send transactional communications; to process subscriptions and generate invoices; to provide support; to detect and prevent fraud or abuse; and to comply with legal obligations.

4. Legal bases & consent

Where applicable law requires, we process personal data on the basis of your consent, the performance of a contract with you, our legitimate business interests, and compliance with legal obligations. You may withdraw consent where processing is based on consent, subject to legal or contractual restrictions.

5. WhatsApp & third-party services

The Service integrates with third-party providers, including the WhatsApp Business API and cloud infrastructure and database providers. When you use these features, your data is processed by those providers under their own terms and privacy policies. We are not responsible for the practices of third parties, and your use of any integration is at your discretion.

6. Data storage, hosting & security

Your data is stored with reputable cloud and database providers and may be processed on servers located in India or other jurisdictions. We apply reasonable technical and organisational measures to protect your data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential and for all activity under your account.

7. Data retention

We retain data for as long as your account is active or as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Upon account termination, data may be deleted or anonymised after a reasonable period, subject to backups and legal retention requirements.

8. Sharing & disclosure

We do not sell your personal data. We may share data with service providers who help us operate the Service, with your agency administrators, when required by law or legal process, or to protect our rights, users, and the public. In the event of a merger, acquisition, or asset sale, data may be transferred as part of that transaction.

9. Your rights

Subject to applicable law, you may request access to, correction of, or deletion of your personal data. Because agencies control their workspaces, some requests should be directed to your agency administrator. To exercise your rights with us, contact us using the details below. We may need to verify your identity before acting on a request.

10. Children

The Service is intended for business use by adults and is not directed to individuals under the age of 18. We do not knowingly collect personal data from children.

11. Terms of Use

  • You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including telecommunications, marketing, and data-protection laws.
  • You are solely responsible for the content and data you enter, including obtaining any necessary consents from the individuals (e.g. leads and contacts) whose information you store, and for how you communicate with them.
  • You must not misuse the Service, attempt to gain unauthorised access, interfere with its operation, or use it to send unlawful, spam, or harassing communications.
  • Subscriptions, seats, and fees are as agreed at the time of purchase. Access may be suspended for non-payment or breach of these terms.
  • All intellectual property in the Service remains ours or our licensors’. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription.

12. Disclaimer & limitation of liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Next Heights and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim shall not exceed the amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim. You agree to indemnify and hold us harmless from claims arising out of your data or your use of the Service.

13. Governing law

This Policy is governed by the laws of India. Subject to applicable law, the courts at our principal place of business shall have exclusive jurisdiction over any disputes arising out of or relating to this Policy or the Service.

14. Changes to this Policy

We may update this Policy from time to time. Material changes will be indicated by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
